Also, for the record, I'm not anti smoking generally, just when in impedes on my airspace haha. Don't get me started on vapers either haha!

I think it depends on how they defined "public space".
It might not include open-air places like the pier.
That said, the Park could chose to prohibit smoking anywhere within its boundaries.

    The answer:
    (8) PUBLIC PLACE. Any enclosed area to which the public is permitted, including, but not limited to, auditoriums, elevators, hospitals, nursing homes, libraries, courtrooms, jury waiting rooms and deliberation rooms, theatres, museums, common areas of retirement homes, restaurants, laundromats, health facilities, educational facilities, shopping malls, government buildings, sports and recreational facilities, places of employment, airports, banks, retail stores, and service establishments. A private residence is not a “public place.”

Where'd you find that Carl? Mine was from the Code of Alabama. I wish government agencies would make finding these things easier!

This happened here a couple years back:

The Chicago Park District Board of Commissionersunanimously voted Wednesday to ban smoking from Chicago's parks and harbors. The measure takes effect immediately. The move expands a ban on smoking at Chicago's beaches, playgrounds and Park District buildings that has been in effect since 2007.Sep 11, 2014

[QUOTE=Nimakdm;128317]Sorry, I suppose they do have them but meant not as stringent was my intention. Up here there's full indoor non residential bans, bans on in the workspace (so even outside you can't technically smoke on a job site, work crew etc) as well as distance from building requirements as well.

Your first post said that the Bible Belt states were the only ones left without any. I couldn't find one that doesn't have one. We don't have totalitarian style gun control laws similar to Chicago but we don't have a city in the South with 198 murders so far this year.

Ok...so in order to avoid a total derail of a thread......

I'll start with that I only smoke around my home, or in a place that it is totally allowed. Such as a bar with an outdoor patio, or a cigar lounge. While I thoroughly enjoy a good cigar, I can totally understand and appreciate those that don't. I only advocate smoking of ANYTHING in a proper place, or if you have permission of the owner of the space. That being said, if I am in such a space, I would also suggest non-participants to exit such a space if they were not inclined to join in the activities.....politely of course.
